What Types of Information Do We Collect From You?
We gather three basic types of information about you through our Websites, which are your Personally Identifiable Information, Non-Personally Identifiable Information and IP Addresses.
Personally Identifiable Information identifies a person as an individual. You do not have to provide Personally Identifiable Information to use the Websites, but we may ask that you do so when we are providing opportunities to you through the Websites. The information we ask for will depend on what opportunity we are providing but may include your name, postal address, telephone number, e-mail address, and for purchases, your credit card number, expiration date, billing address and related details including any validation code. We may also provide functionality so that you can send messages about Website-related content to a friend, for example music clips and artist information. By using this functionality, you affirm that you are entitled to provide us with the recipient's name and email address for this purpose.
We may also collect Non-Personally Identifiable Information from visitors and registered users of the Websites. This type of information does not personally identify you. We may ask you to provide some of that information yourself, such as your musical preferences, your favourite artists, record labels or genres. Other technical, geographic and usage data and information we may collect directly, such as your browser type, ISP, operating system, log and Website usage data, IP address, cookies, zip/postal code or location, the pages you visit and music or other content that you listen to or access while on the Websites, websites you've visited upon entering or leaving the Websites, and if you purchase or sell content through the Websites we will keep track of those purchases and/or sales. Such information may be combined with your personal information.
Your Internet Protocol (IP) address is a number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is logged automatically in our server log files whenever you visit the Websites, along with the time of your visit and the pages that you visited. Collecting IP addresses is standard practice on the Internet and is done automatically by many websites.
What do we do with the information we collect?
Our main use for the Personally Identifiable Information we collect is to process your registration, purchases and payments, and to maintain your account on an ongoing basis. If you are a Digital Content Provider, we will also use your personal information to make accountings and pay royalties to you. If you enter any contests, promotions, giveaways or other optional programs, we will use the information you provide to facilitate and communicate with you about that particular transaction, including notifying you about whether you've won and to deliver the prize.
We may also use your Personally and Non-Personally Identifiable Information to enhance your experience with the Websites and our service, such as sending you emails and otherwise providing you with other information, content and material in which we think you may be interested; displaying content and ads according to your prior browsing history, preferences and location; fulfilling your orders; providing customer service and responding to your questions and comments; or contacting you about your account or about our promotions, contests, surveys, or other promotions.
We may use information learned from cookies and web beacons to make sure that our content and emails are in a format that you can read, to analyze trends about which Websites, content and emails are popular and are being read and/or forwarded, to maintain a history of email activity, and to evaluate the effectiveness and efficiency of certain communications.
Your feedback and other information will also be used to evaluate and enhance our Websites and service. For example, we may analyze the traffic and usage of our Websites; the participation rate of our various promotions, offerings, emails, and other programs; and the popularity of our content, artists, and participating suppliers. We may also use that information for product development purposes, such as determining what other record labels, artistes, products and services our users are interested in, and for technical purposes such as monitoring the functionality of our servers and email systems.
We may use your Personally, Non-Personally Identifiable Information and IP Addresses for any legal purpose required or permitted by the law of any country.
Do we share the information we collect with third parties?
We may share the information that we collect, both Personally and Non-Personally Identifiable Information, with third parties such as advertisers, contest sponsors, promotional and marketing partners, and the record labels, artistes and others who provide our content or whose products or services we think may interest you.
We may engage trusted third party service providers to perform functions and provide services to us, such as hosting and maintaining our servers and the Websites, database storage and management, email management, storage marketing, credit card processing, customer service and fulfilling orders for products and services you may purchase through the Websites. We will likely share your Personally Identifiable Information, and possibly some Non-Personally Identifiable Information, with these third parties to enable them to perform these services for us and for you.
We may share portions of our log file data, including IP addresses, for analytics purposes with third parties such as web analytics partners, application developers, and ad networks.
We may also disclose Personally and Non-Personally Identifiable Information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate in order to respond to claims, legal process (including subpoenas), to protect our rights and interests or those of a third party, the safety of the public or any person, to prevent or stop any illegal, unethical activity, or to otherwise comply with applicable court orders, laws, rules and regulations.
Is your information secure?
We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access. All credit transactions occur in a secure area of the Websites using Secure Sockets Layer (SSL) software to process orders, which encrypts the information you input on the Websites. For the storage and processing of credit card information, we engage a third party certified as compliant with the Payment Card Industry Data Security Standard (PCI DSS).
In addition, all Personally Identifiable Information is stored behind a firewall with limited administrative access. However, please be aware that despite our best efforts, no security measures are perfect or impenetrable and that no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.
Any information or material you may enter in publicly viewable portion of the Websites, such as on a product page comment section, or blog will be readily accessible to the general public. Therefore, do not enter in those areas of the Websites any Personally Identifiable Information (e.g., your name, e-mail or postal address, credit card details) or other information or materials that you would not wish to be publicly available.
Where do we store and use your information?
We collect, store and process the information we collect in Canada. If you are outside Canada, then your Personally and Non-Personally Identifiable Information may be transferred to Canada.
Other Important Notices:
Opt-Out. We give you many choices regarding our use and disclosure of your Personally Identifiable Information for marketing purposes. You may opt-out from receiving marketing-related emails from us. If you later decide you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out from receiving such emails either by using the unsubscribe mechanism provided in the email or by emailing us at customerservice[at]tikaymusic.ca. Please note that, if you do opt-out from receiving marketing-related messages from us, we may still send administrative messages to you; you cannot opt-out from receiving administrative messages.
Note Regarding the Use of the Websites by Children. The Site is not directed to individuals under the age of thirteen (13), and we request that these individuals do not provide Personally Identifiable Information through the Websites.
Jurisdictional Issues. We do not represent or warrant that the Websites, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Websites do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the Website's availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. By using the Websites and submitting any Personally Identifiable Information, you consent to the transfer of Personally Identifiable Information to other countries, such as Canada, which may provide a different level of data security than in your country of residence.
